These Terms and Conditions ("Terms") govern your use of the Apex Site Safety website and any inquiry, application, or safety team request you submit through it. By using this site, you agree to these Terms. If you do not agree, please do not use the site.
Employment relationship
Apex Site Safety hires, employs, and manages the safety professionals it assigns to projects. If anyone claiming to represent us requests payment from you for employment, registration, or job search assistance, do not pay. Report it to us immediately at info@ApexSiteSafety.com.
No guarantee of employment
Submitting information through this website does not create an employment relationship, an offer of employment, or a contract of any kind, and does not guarantee an assignment, an interview, a specific rate of pay, or a duration of assignment. Job descriptions, pay ranges, project references, and timelines shown on this site are illustrative and subject to change without notice.
At-will employment (Texas)
Texas is an at-will employment state. Unless a signed written agreement expressly states otherwise, any employment or assignment is at will and may be terminated at any time, with or without cause or notice, by either party. Nothing on this website alters at-will status.

Work authorization and screening
All assignments are contingent on verification of identity and authorization to work in the United States (Form I-9) and, where applicable, on satisfactory reference checks, credential verification, background checks, and drug or alcohol screening conducted in compliance with the FCRA and applicable state law.
Safety services disclaimer
Apex Site Safety employs and manages safety and consulting personnel who are assigned to client sites. We are not an insurer, a law firm, or a regulatory authority, and nothing on this website constitutes legal, regulatory, insurance, engineering, or medical advice. Responsibility for site conditions, OSHA and Texas Department of Insurance, Division of Workers' Compensation obligations, and compliance with all applicable laws remains with the site owner, general contractor, and employer of record as defined in the applicable services agreement. Client engagements are governed by the executed services agreement, which controls over these Terms in the event of a conflict.
Workers' compensation notice
Workers' compensation coverage, employer-of-record status, and insurance requirements for each assignment are set out in the applicable client services agreement and employment or assignment paperwork. Texas law does not require most private employers to carry workers' compensation insurance; coverage status for any assignment will be disclosed to you in writing before you begin work, as required by Texas law.
Accuracy of your submissions
You agree that all information you submit is truthful, accurate, and your own. Submitting falsified credentials, certifications, or references is grounds for immediate disqualification or termination and may be reported to the relevant credentialing body.
Intellectual property
All content on this site, text, graphics, logos, photographs, and layout, is owned by or licensed to Apex Site Safety and may not be copied, reproduced, or used commercially without written permission.
Third-party links
This site may link to third-party websites. We are not responsible for their content, practices, or privacy policies.
Disclaimer of warranties and limitation of liability
This website is provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law. To the maximum extent permitted by Texas law, Apex Site Safety is not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of this website. Nothing in these Terms waives or limits any right you may have under the Texas Deceptive Trade Practices–Consumer Protection Act (Tex. Bus. & Com. Code Ch. 17) that cannot be waived by law.
Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any dispute arising out of or relating to this website or these Terms shall be brought exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction and venue there.
Changes
We may modify these Terms at any time. Continued use of the site after changes are posted constitutes acceptance of the revised Terms.
